Discrimination: Understanding Protected Classes

As a landlord, it is important to choose a tenant that has the ability to pay and will abide by the rules of the tenancy. In selecting a tenant, there are also laws that one must abide by in not discriminating against a protected class in Massachusetts. What are these protected classes?

  • Race

  • Physical or mental disability

  • Color

  • Religion and creed

  • Age

  • National origin

  • Sex

  • Sexual orientation

  • Ancestory

  • Familial status

  • Marital status

  • Source of income

  • Veteran status

Legal Reasons to Refuse to Rent

If you feel you are justified in refusing a tenant, we recommend speaking with an attorney. Typically, you can refuse based on poor credit history or insufficient income. Additionally, families with children may be legally denied renting in an owner-occupied two family house or in some situations where an elderly person resides.
